Consider and take action on an ordinance amending Chapter 110 of the Code of Ordinances of the City of League City entitled “Traffic and Vehicles”, by amending Article V “Operation of Vehicles”, to add Section 110-144 entitled “Off-Road Operation of Motor Vehicles” (Chief of Police)

Background:
Approval of this ordinance will amend Chapter 110 of the Code of Ordinances of the City of League City entitled “Traffic and Vehicles”, by amending Article V “Operation of Vehicles”, to add Section 110-144 entitled “Off-Road Operation of Motor Vehicles”. Over the past ten (10) years we have averaged in excess of 200 calls for service per year through the League City Police Department from citizens complaining of the operation of motorcycles (dirt bikes) and ATVs that are being driven in common areas of subdivisions and the green belts and pipeline rights-of-way behind citizens’ homes. Traditionally, the responding officers would provide warnings, but if the complaints continued, officers would issue citations for violating an City Ordinance related to “Noise”.

In discussion with the City Attorney, it was advised that to address future complaints about issues with motorcycles (dirt bikes) and ATVs that it would be more appropriate to amend Ordinance Chapter 110 Traffic and Vehicles, Article V Operation of Vehicles by adding Section 110-144 Off-Road Operation of Motor Vehicles. This ordinance would make it unlawful for any person to operate a motor-driven or motor-propelled vehicle on another’s property within the City of League City, except upon a surface constructed for vehicular traffic, without being in the visible presence of the record owner of said property or having in said person’s possession written permission from the said owner or his authorized agent that is notarized by a public notary of Texas.

These changes have been recommended and approved by the City Attorney.
