Title
Hold a public hearing on an amendment to Chapter 42, Article II of the League City Code of Ordinances entitled, “Noise” by amending Section 42-36 (5) to allow the Director of Planning and Development to grant an exception for noise generated by construction activities (Director of Planning and Development)

Background:
The Planning and Zoning Commission is scheduled to hear the request on May 14, 2018. The current ordinance requires that no noise is to be generated at a construction site outside of the times of 7:00 AM to 7:00 PM. Certain circumstances may warrant construction to occur beyond the said time frames. The proposed ordinance amendment provides additional work hours at certain construction sites. The proposed changes will allow the Director of Planning & Development the authority to approve construction outside of the normal work hours. An example of an exception includes a school that must complete construction during hours when school is not in session.

The proposed regulations will read as follows with the text amendment in italics and underlined:

(5) The sound was produced by the erection, excavation, construction, demolition, alteration, or repair work, or the permitting or causing thereof, of any street, building or other structure, or the operation or the permitting or causing the operation of any tools or equipment used in any such activity conducted between the hours of 7:00 a.m. and 7:00 p.m. (unless otherwise approved by the Director of Planning & Development) and which activity did not produce a sound exceeding 75 dB(A) when measured from the nearest residential property where the sound is being received.

Staff Recommendation: Staff recommends approval of the proposed text amendments.
