Title

Consider and take action on Ordinance 2018-11 amending Chapter 54 of the Code of Ordinances of the City of League City entitled "Health and Sanitation" by amending Section 54-32 to prohibit property conditions that cause pest infestation - Second Reading (Director of Planning and Development)

Council postponed 8-0-0 on April 24, 2018.

Council approved 8-0-0 on first reading on May 8, 2018.

Background:

Approval on Ordinance 2018-11 to amend Chapter 54 of the Code of Ordinances of the City of League City entitled "Health and Sanitation" by amending Section 54-32 to prohibit property conditions that cause pest infestation.

Project Timeline:

March 2, 2018 -  Code Compliance was transferred a phone complaint from Animal Control regarding a pest infestation. It was revealed that neither Animal Control nor Code Compliance had an ordinance to address pest harborage, therefore a citation was not issued.

March 6, 2018 - Code Compliance met with the League City Police Department and Animal Control to discuss the issue. It was confirmed that there was not a City ordinance to address pest infestation issues and a meeting was scheduled to discuss a new ordinance on April 5, 2018.

April 5, 2018 - A meeting with City staff was held to discuss a new ordinance. In attendance were: Chief Ratliff and Assistant Chief Spencer of the League City Police Department; Deputy City Attorney Michelle Villarreal; Animal Services Manager Kim Schoolcraft; and Neighborhood Services Manager Frank LeBlanc, and Senior Code Compliance Officer Mary Contreras. A consensus was reached at the meeting for the Legal Department to craft an amendment to Section 54-32 of the City Code to address pest harborage and infestation within the City and for Code Compliance to be responsible for enforcement of said ordinance.

Project Summary:

The proposed regulations will allow Code Compliance to address property conditions that may attract or harbor pests.  This amendment will replace the current section 54-32, entitled "Accumulations of unwholesome matter".  The current section entitled "Accumulations of unwholesome matter" is a redundant section because such violations are already addressed in section 54-33, entitled "Accumulations of rubbish or growth of weeds".  Staff recommends approval of this ordinance amendment.

Council approved this ordinance on first reading 8-0-0 on May 8, 2018.
