Consider and take action on a resolution approving utility conveyance and security agreements with Galveston County Municipal Utility District No. 45 for water and sanitary sewer facilities associated with the 12” Water and 12” Sanitary Sewer Extension crossing South Shore Blvd and FM 646 (Director of Engineering)

 

Background:

Approval of this resolution will approve utility conveyances and security agreements with Galveston County Municipal Utility District No. 45 (the “District”) for public infrastructure associated with the project known as the 12” Water and 12” Sanitary Sewer Extension Crossing S. Shore Blvd and FM 646.

 

The District has constructed certain water and sanitary sewer facilities and is formally conveying the facilities to the City pursuant to the Utility Agreement, by and between the City and the District approved on September 23, 2003 by Ordinance 2003-53, first amended on March 28, 2006 by Ordinance 2006-17, and amended a second time on October 24, 2006 by Ordinance 2006-96. Subject to a security interest retained by the District, the agreement requires that these facilities be conveyed to the City for ownership, operations and maintenance.

 

The municipal infrastructure for the development was accepted by the City on May 8, 2018.
