Consider and take action on a resolution determining which recommendations from the Charter Review Advisory Committee will be included as Charter propositions on the 2018 November election ballot (City Attorney)

 

Background:

Approval of this resolution will accept the report from the Charter Review Advisory Committee and give direction to staff on which propositions will be included on the November election ballot. 

 

On March 28, 2017 through Resolution 2017-56, the City Council established the 2017-2018 Charter Review Advisory Committee ("Committee").  The Committee had 16 members who where were tasked with evaluating the Charter's provisions with respect to redundancy, applicability and relevancy especially as it relates to the City's operations.  After multiple meetings, the Committee presented its recommendations, which are summarized below, at the May 22, 2018 Council Work Session.  Under the terms of Resolution 2017-56, the Committee officially disbanded on June 1, 2018. 

 

Committee Recommendations:

 

1.                     Annexation - Simplify annexation section to state that the City will comply with state law

2.                     Terms of Council - Clarify that no Member of Council can serve more than 2 consecutive terms

3.                     Council Absences - Clarify that a Council vacancy becomes effective 30 days after third unexcused absence

4.                     Mayor Pro Tem - Clarify that the Mayor Pro Tem will be elected every November

5.                     Actions of Council Part 1 - Clarify that all actions of Council shall be recorded in minutes

6.                     City Treasurer and Collector - Remove this function from office of City Secretary

7.                     Actions of Council Part 2 - Clarify that all actions of Council shall be recorded in minutes

8.                     Money Transfers between Directorates - Change verbiage to specifically mention directorates

9.                     Payment of Property Taxes Part 1 - Simplify section to state that taxes shall be paid at designated tax office

10.                     City Property Assessment Board - delete this section, City uses County appraisal districts

11.                     Payment of Property Taxes Part 2 - Simplify section to state that taxes shall be paid at designated tax office

12.                     Joint Property Interest - Delete this section as it doesn’t impose a rule or restriction on City

13.                     Previous Red-Light Vendor - Delete reference to previous vendor but leave prohibition

14.                     City Secretary’s Bond - Delete requirement that City Secretary pays for her own bond

15.                     Payment of Claims - Delete section, state law and city financial policy controls payment of claims
