Consider and take action on an ordinance amending Ordinance 2010-19 to clarify that the Mayor has the authority to appoint all members of the City’s boards, commissions and agencies, subject to confirmation by the City Council (City Attorney)

 

Background:

Approval of this item will amend Ordinance 2010-19 to clarify in the Charter that the Mayor has the authority to appoint all members of the City's boards, commissions and agencies, subject to confirmation by the City Council.

 

On May 8, 2010, the City held an election concerning 19 separate Charter propositions.  Proposition 4 asked "Shall Article II, Section 17, paragraph 2 of the City Charter be amended to provide that the Mayor will have the exclusive power to appoint officers for boards, commissions and agencies of the city, subject to confirmation by the City Council?".  The voters approved Proposition 4 with 1,677 votes cast for and 1,090 votes cast against.

 

According the section 9.005 of the Texas Local Government Code, a charter amendment does not take legal effect until the City Council passes an ordinance declaring the charter amendment is adopted.  When the City Council passed Ordinance 2010-19 to give legal effect to the voter-approved Charter propositions, the language in the ordinance did not give full effect to Proposition 4 as it was worded on ballot.

 

This ordinance amends Ordinance 2010-19 to give full effect to Proposition 4 of the 2010 Charter Election.
