Consider and take action on an ordinance amending Chapter 98, Article IV of the Code of Ordinances of the City of League City entitled, “Abandonment of Public ROW or Easements and Sale or Exchange of Land and other Real Property Interests” (Director of Engineering)

Background:
Approval of this ordinance will amend Chapter 98, Article IV of the Code of Ordinances of the City of League City entitled, “Abandonment of Public ROW or Easements and Sale or Exchange of Land and other Real Property Interests”. Chapter 98, Article IV details the requirements for abutting property owners seeking the consent of the City Council to abandon, vacate, or close any public ROW or easements.

The proposed amendment to Article IV in Chapter 98 is as follows:

· Section 98-116 adds Item #6 and requires the applicant to provide “No Objection” letters from Franchised Utilities (TNMP, Centerpointe, Comcast, etc.). In the past, this coordination was handled by the City.
· Section 98-117 Item “a” increases the application fee from $2,250 to $3,250. Recently, the costs of appraisals have been in the $3,000 range which exceeds the application fee. This increase to $3,250 is intended to cover the cost of the required land appraisals ($3,000) and staff processing time ($250).
· Section 98-117 Item “b” updates the application fee amount and requires the applicant to 100% of the appraisal costs if the appraisal cost exceeds $3,000. For instance, when applying for the ROW abandonment, the applicant would pay $3,250 with the application ($3,000 for appraisal and $250 for staff processing time). If the cost for the appraisal came in at $3,500, the applicant would be required to pay an additional $500 prior to the application moving forward, meaning that the total application would cost $3,750 ($3,500 for appraisal and $250 for staff processing time).
