Title

Consider and take action on a resolution setting the date for a Public Hearing on August 28, 2018, to consider adoption of the Land Use Assumptions and Capital Improvements Plan under which Capital Recovery Fees may be imposed for roadways within the City; directing the City Secretary to Publish Notice of said Public Hearing; and directing the Capital Improvements Advisory Committee to consider and make recommendations on the Land Use Assumptions and Capital Improvements Plan. Background:

Approval of this resolution will authorize the City Secretary to publish Notice of a Public Hearing to consider adoption of the Land Use Assumptions and Capital Improvements Plan and direct the Capital Improvements Advisory Committee (CIAC) to consider and make recommendations on the Land Use Assumptions and Capital Improvements Plan.

As outlined in Chapter 395 of the Texas Local Government Code, a City, wishing to consider the adoption of impact fees, must establish a Public Hearing date within 60 days of approving this resolution. Staff wishes to hold this public hearing on August 28, 2018 as part of the scheduled City Council session. A Public Notice for this Hearing would need to be published no later than July 27, 2018.

For Roadway Capital Recovery Fees (CRF) to be established, the 10-yr Land Use Assumptions (LUA) Report and a specific Capital Improvements Plan (CIP) must be used. The LUA report contains a projection of anticipated population and employment growth in the City over the upcoming 10-yr period. Based on this projected growth, a Roadway CRF CIP is developed and associated costs to implement the roadways developed. The CRF is based on the cost of necessitated growth over the planning period. The cost to a specific development is then allocated based on traffic demand created (capacity consumed) on the roadway network.
