Consider and take action on an ordinance re-appointing Kerri Foley as the temporary associate judge of the municipal court of record for a sixty (60) day period ending on October 10, 2018 and authorizing an agreement with Kerri Foley for various judicial services at a rate of $150 per hour (Direction of Human Resources and Civil Service)

Staff recommends approval on first and final reading.

Background:
Approval of this agenda item will re-appoint Kerri Foley as the temporary associate judge for a second sixty (60) day period ending on October 10, 2018 and authorize an agreement with Kerri Foley for various judicial services at a rate of $150 per hour.

Under Section 30.00008 of the Texas Government Code, if a vacancy occurs in the office of the municipal judge of a court of record, the governing body shall by ordinance or charter provide for the appointment of a qualified person to fill the office. Also, under Article V, Section 6 of the City of League City Charter provides that if the municipal judge is unavailable, the City Council may appoint an alternate judge for a period not longer than sixty (60) days.

The City currently has two municipal court judge positions: a chief judge and an associate judge. The previous associate judge recently retired from his position. The City is in the process of locating and recruiting a permanent associate judge replacement

In order to ensure that municipal court dockets are handled in a timely manner while the City completes its recruitment process, the City previously appointed Judge Kerri Foley as a temporary associate judge for a sixty (60) day period ending on August 11, 2018. This agenda item will re-appoint Judge Kerri Foley for a second sixty (60) day period ending on October 10, 2018, while the City finalizes its recruitment process for a permanent associate judge replacement.

CONTRACT ORIGINATION: The Agreement has been drafted by the City Attorney's Office.
