Consider and take action on a resolution authorizing an encroachment agreement with Gehan Homes, Ltd. for the installation and maintenance of irrigation and landscape improvements within public road right-of-way, utility easements and restricted reserves within the Victory Lakes Sections 7A and 7B (Director of Engineering)
Background:
Approval of this resolution will authorize an encroachment agreement allowing Gehan Homes, Ltd. to install and maintain City permitted private irrigation and landscape improvements within the Victory Lakes Sections 7A & 7B.
The City is not giving up any of its rights, and Gehan Homes Ltd., and/or its successors, are responsible for any maintenance and repairs to the privately-owned irrigation and landscape improvements. It has also been noted in the attached Encroachment Agreement that any tree planted within the dedicated roads right-of-way, utility easements, and Restricted Reserves shall have a root barrier.
