Consider and take action on a resolution repealing Resolution 2006-29 and re-establishing Galveston County Municipal Utility District #73 with new boundaries (Director of Planning and Development)
Background:
Approval of this item will officially change the configuration and boundaries of Municipal Utility District No. 73 (“MUD 73”).
On July 11, 2006, the City consented to the creation of MUD 73 through Resolution 2006-29 and established its boundaries.
When the development of MUD 73 stalled, a new developer subsequently acquired all property interests in MUD 73 and worked with the City to develop a new plan for the development of MUD 73. As part of the new plan, the new developer wishes to change the configuration of the MUD 73 to align with the new development plan.
The City Council has already approved the new development plan on January 22, 2019 when it approved Ordinance 2019-04 for the amended and restated utility agreement for MUD 73 and when it approved Ordinance 2019-03 for the amended Duncan PUD. This agenda is the item is the last council action needed to finalize the new boundaries for MUD 73.
