Consider and take action on a resolution updating and adopting a schedule of fees pertaining to buildings and building regulations - Chapter 22 of the Code of Ordinances of the City of League City (Director of Planning and Development)

Background:
Adoption of this Resolution will update the Buildings and Building Regulation Fee Schedule that was last reviewed and updated on November 13, 2018 through Resolution 2018-169.

Governor Abbott signed HB 852 in to law on May 21, 2019, which caused an immediate change to the permitting process in the State of Texas for residential construction. HB 852 adds Section 214.907 of the Texas Local Government Code, which is listed below.

Sec. 214.907. PROHIBITION ON CERTAIN VALUE-BASED BUILDING PERMIT AND INSPECTION FEES.
(a) In determining the amount of a building permit or inspection fee required in connection with the construction or improvement of a residential dwelling, a municipality may not consider:
(1) the value of the dwelling; or
(2) the cost of constructing or improving the dwelling.
(b) A municipality may not require the disclosure of information related to the value of or cost of constructing or improving a residential dwelling as a condition of obtaining a building permit.

Section 214.907 was added and no warning or adjustment time was given to cities to account for the changes.

League City, like most other cities in the State used a valuation system to compute permit fees. That now has to be changed.

Staff is proposing that the City use a square-foot-basis methodology and a new permit fee chart is included and recommended for adoption.

Cities around the State are proposing anywhere from .30 to .85 cents a square foot.

Staff is proposing .40 a square foot.

Calculations have been examined to compare the valuation rate that has been in effect to the proposal of the square footage rate and the difference is very minor with a slight increase for larger homes.
