Consider and take action on a resolution: 1) authorizing a construction contract with Angel Brothers Enterprises Ltd. for the Asphalt Streets Rehabilitation Project Package 4 (RE1704D) in an amount not to exceed $3,828,446.64, with an expenditure of an additional $382,844 for a construction work change directive budget and 2) authorizing a construction material testing services contract with Terracon in an amount not to exceed $90,452 for a total construction budget of $4,301,742.64 (Director of Budget & Project Management)

 

Background:

Approval of this resolution will authorize the award of a construction contract to Angel Brothers Enterprises, Ltd. for construction of Package 4 of the Asphalt Streets Rehabilitation Project (RE1704D), authorize funds for a construction work change directive budget, and authorize a construction material testing services contract with Terracon.

 

The purpose of this project is to perform road base repairs and asphalt resurfacing as part of an annual infrastructure reinvestment program on approximately 17,853 linear feet of asphalt roads. Reviewing the completed product for Asphalt Packages 1, 2, and 3 led staff to propose a more robust rehabilitation of asphalt roads. The previous asphalt projects have been requiring additional repairs due to unforeseen sub-base failures after the contractor’s warranty period. The standard method of repair has been for the contractor and City Staff to note base failures after the milling and proofrolling with a 20-ton roller operations.  The areas noted are repaired with full-depth spot repairs. These additional post-construction repairs not only burden Staff’s time and efforts but also shorten pavement life.

 

For the Package 4 project, City Staff has inspected the proposed streets for repair and identified which streets need full depth reclamation and which streets just need mill and overlay. Additionally, the proofrolling has been increased to a 24-ton roller which will better identify potential weak spots.  With the new proposed method which includes some streets receiving full depth reclamation for the entire length,  the bid of Package 4 was broken into three sections.  The base bid included: David Avenue, Houston Avenue, East Galveston Street, East Saunders Street, East Wilkins Street, Interurban Street, West Saunders Street, West Wilkins Street. The second section as Alternate #1 included: Iowa Avenue, South Kansas Avenue, and South Illinois Avenue.  Alternate #2 as the third section included: Colorado Avenue and Michigan Avenue.

 

One Sealed bid for the project was received on July 23, 2019 (Bid No. ITB 19-CIP 023). Angel Brothers Enterprises, Ltd. submitted a base bid in the amount of $2,482,007.00 with a bid for Alternate #1 in the amount of $689,189.90 and bid for Alternate #2 in the amount of $657,249.74.   The total for the base bid and all alternates is $3,828,446.64.  The engineering consultant’s recommendation of award and the bid tabulation are attached.

Staff requests the approval of the award of the construction contract and the authorization of funds as follows:

1.                     Construction contract with Angel Brothers Enterprises, Ltd. in the amount of $3,828,446.64

2.                     Construction work change directive budget in the amount of $382,844 (10% of construction amount) that will allow staff to approve minor field changes to expedite decisions and avoid possible construction delays and/or damage claims by the contractor.

3.                     Construction material testing services contract in the amount of $90,452. The materials used in this project require testing in accordance with the contract documents, whereas the City is responsible to employ and pay for services of an independent testing laboratory.

 

The FY2019 CIP programmed funds in the amount of $2 million for the design and construction of Asphalt Package 4.  After funding the design contract, $1.84 million remained for construction of Aphalt Package 4.  This agenda item is appropriating $4.3 million.  The additional $2.46 million in funding is made possible due to the cash flow needs of the reinvestment program.  Other reinvestment projects programmed in FY2019 will not need those funds until FY2020.  This delay along with the FY2020 Proposed CIP programming funds in the amount of $3.525 million in FY2020 for the Asphalt Rehab project provide staff with the opportunity to award the entire Asphalt Package 4 at this time.  In FY2020, the Asphalt Rehab Project funding of $3.525 million will be reduced by the $2.46 million overage appropriated with this agenda item to fund the delayed reinvestment projects from FY2019.
