Consider and take action on a resolution to enter into a Master License Agreement for Hike and Bike Trails with CenterPoint Energy Houston Electric, LLC for the Claremont Connector Trail Project (PK1703) and for future trail projects within CenterPoint Energy Houston Electric, LLC’s (CPE) easements (Director of Budget & Project Management)


Background:
Approval of this resolution will formally authorize the City to enter into a Master License Agreement for Hike and Bike Trails with CPE for hike and bike trails within their easements.

Acceptance of the Master License Agreement for Hike and Bike Trails will give approval from CPE for installation of the Claremont Connector Trail Project within CPE easement, allow the City to accept a previously constructed trail by a developer in CPE easement, and expedite easement approvals for future trails to be within CPE easements.

The agreement outlines CPE key conditions, requirements and restrictions for trails within their easements including the following:
- 20-year agreement term with automatic annual renewal with same conditions until terminated by either party; if the agreement is terminated, CPE may require the City remove the trails
- use of trails permitted dawn to dusk daily
- bollards shall be installed at all vehicular access points along the trail to limit unauthorized vehicular access
- the City shall trim and maintain any vegetation 10-feet on each side of trail within CPE easement
- the City is responsible for any complaints regarding the trail within CPE easement
- Insurance requirements are outlined in #21 (beginning on page 8) for Contractor's installing or repairing trails within CPE easements


Award of construction contract for the Claremont Connector Trail is on this same agenda for Council approval. An agreement with CenterPoint Energy is required to construct the Claremont Connector Trail.
