Title
Consider and take action on an ordinance granting consent to the reduction of the City's extraterritorial jurisdiction by releasing therefrom certain territory to the City of Dickinson; providing for severability; and containing other provisions relating to the subject (City Attorney)

Background:
Approval of this agenda item will grant consent to the reduction of the City's extraterritorial jurisdiction by releasing certain territory to the City of Dickinson.

On December 11, 2018 via Resolution 2018-195, the City authorized an interlocal agreement between the League City, Dickinson and Galveston County for the renovation of Pin Oak Drive.

Pin Oak Drive, which is located between the boundaries of the City of League City and the City of Dickinson, needs repair. Galveston County has agreed to serve as Project Manager and provide the equipment and manpower to renovate Pin Oak Drive, if League City and Dickinson will provide for the cost of materials for the Project. League City's portion of the materials is $6,723 and Dickinson's portion is $13,650.

In addition, Dickinson has asked that League City release approximately 640 feet of Pin Oak Drive and 280 feet of unimproved Pin Oak Right-of-Way from its extraterritorial jurisdiction so that Dickinson can annex those portions and bring Pin Oak Drive under its jurisdiction and maintenance. Galveston County has asked that League City annex 1270 feet of unimproved Pin Oak Right-of-Way from Geisler Gully to the end of the Pin Oak Right-of-Way.

Under Section 42.023 of the Texas Local Government Code allows the extraterritorial jurisdiction of a municipality to be reduced if the governing body of the municipality gives its written consent by ordinance or resolution. This ordinance will satisfy the requirements of Section 42.023.
