Consider and take action on a resolution authorizing an Interlocal Agreement with the Galveston County Water Control and Improvement District No. 12 for an Emergency Water Supply Interconnection (Director of Public Works)
Background:
Approval of this resolution will authorize the Interlocal Agreement with the Galveston County Water Control and Improvement District No. 12 (WCID12) for an Emergency Water Supply Interconnection.
The City received a letter dated September 16, 2015 from WCID12’s District Engineer, LJA Engineering Inc., requesting an Emergency Water Supply Agreement which creates a water system interconnection between League City and WCID12, along FM 518 near the City’s eastern boundary with WCID12 (Kemah). Ongoing agreement negotiations continued through 2017 and was presented to Council in a work session on May 22, 2017. Several contributing factors including Hurricane Harvey prolonged finalizing the proposed agreement. The agreement will provide an emergency water interconnection with WCID12, in the event of a water supply interruption. Currently WCID12 is serviced by a 12” water line from the Gulf Coast Water Authority’s (GCWA) Thomas Mackey Water Treatment Plant (TMWTP) in Texas City. This water line is located along SH146 and serves as their sole surface water supply source. In the event of an extended interruption of service from the TMWTP and/or the associated conveyance system, and/or failures of WCID12’s water distribution system, no provisions exist for an emergency source of surface water supply.
Approval of this agreement provides WCID12 the ability to receive limited emergency water supply upon formal request to the City, and to construct the physical interconnection of their water system to the City’s existing water distribution system, at their own expense. Detailed construction plans were reviewed and approved by the City’s Engineering Department. The associated scope of work provides; meter vault with 6” inch Sensus Omni F2 meter; above-grade reduced pressure backflow preventer; and all associated valves and site work. The interconnection site will be installed on the City’s existing 12” inch water line near FM518 and Lawrence Rd.
Specific details of the agreement are as follows:
1. This agreement does NOT relinquish any of the City’s current surface water capacity and will serve WCID12 as an Interruptible Emergency Water Supply only.
2. The initial rate is $3.75 per 1,000 gallons for the first twelve months of the agreement term followed by a 2.5 percent escalator implemented on October 1st of each year for the proposed ten-year agreement. A $40 per month administration fee is included.
3. Interconnection will be constructed at the sole expense of WCID12.
4. The trigger term “Emergency” is defined in Section 2.1 as “Emergency shall mean as mechanical or electrical failure causing a loss of fifty percent (50%) or more of the productive capacity of a party’s water system or a fire requiring immediate use of the other party’s system for firefighting purposes and activities related thereto”.
5. Each party is responsible for maintaining interconnection on its’ respective side of Point of Connection (COLC water meter).
6. WCID12 is responsible for maintaining and providing annual certification of reduced pressure zone device.
7. Each party will have locked and secured access of their own respective operation valves along with requiring both parties to be present on-site when implementing emergency interconnection operation.
8. Volume and demand limitations are defined as “the amount of water delivered by the City to WCID12 and the rate of flow thereof shall not exceed the rate of capacity of the City’s water facilities installed for delivery of emergency water service”. This means that although there is not a cap on volume delivered, the City can stop or control delivery at its discretion based on the demand requirements of the City’s water distribution system. There are no obligations for service if League City customers are negatively impacted.
The City Attorney’s office has reviewed the agreement and found terms and conditions to be acceptable.
