Title

Consider and take action on a resolution determining a public necessity to acquire real property interests in certain properties for the Southeast Service Area Trunks Project (WT1105), and authorizing the use of eminent domain powers for the acquisition of real property interests in the properties (Director of Budget & Project Management)

 

Background:

If approved, this resolution establishes the public necessity to acquire real property interests in certain properties, and authorizes the uses of eminent domain powers, if necessary, for the acquisition of real property interests in the properties. 

 

This project provides the final two segments of trunk lines to serve the east side development and redundant supply to the East Side Elevated. This will complete the south loop to South Shore Boulevard running north to FM 646.  Both segments of 24-inch waterline run East-West along FM646.  Segment 3 runs from FM270 to FM1266 (Tuscan Lakes Blvd).  Segment 5 runs from FM1266 (Tuscan Lakes Blvd) to South Shore Blvd.

 

Design plans are 100% plans complete. Construction is anticipated to begin in FY2021 pending land acquisition.

 

Staff continues discussions with property owners to acquire the property necessary for the Southeast Service Area Trunks.  One of the steps to move forward with the acquisition of land, if there is no agreement on price, is to declare eminent domain.  Prior to filing an eminent domain case, Council will be apprised of the status of the land negotiations and staff’s recommendation to file the case.
