Title

Consider and take action on a resolution determining a public necessity to acquire real property interests in certain properties for the North Landing Extension Project (ST1914), and authorizing the use of eminent domain powers for the acquisition of real property interests in the properties (Director of Budget & Project Management)

 

Background:

If approved, this resolution establishes the public necessity to acquire real property interests in certain properties, and authorizes the uses of eminent domain powers, if necessary, for the acquisition of real property interests in the properties. 

 

The proposed project includes the construction of approximately 1.7 miles of four-lane urban divided boulevard.  Currently, the City is awaiting 60% design plans to review.

 

Staff continues discussions with property owners to acquire the property necessary for the North Landing Extension project.  One of the steps to move forward with the acquisition of land, if there is no agreement on price, is to declare eminent domain.  Prior to filing an eminent domain case, Council will be apprised of the status of the land negotiations and staff’s recommendation to file the case.
