Title

Consider and take action on a resolution determining that land is needed for the construction and improvements associated with the Grissom Road Reconstruction Project in the City of League City Texas, specifically a tract of land containing 5.1094 acres believed to be owned by Clearfield Realty Inc. and authorizing the institution of eminent domain proceedings (Director of Budget & Project Management)

 

Background:

If approved, this resolution re-establishes the public necessity to acquire real property interests in certain properties, and authorizes the uses of eminent domain powers, if necessary, for the acquisition of real property interests in the properties. 

 

Grissom Road reconstruction project replaces approximately 5,600 feet of an existing two-lane rural open ditch roadway with a four-lane divided urban roadway. It will provide a pedestrian sidewalk, as well as drainage mitigation required for increased runoff. This project will also include approximately 5,000 feet of 12-inch waterline from the North Service Area Booster Station to West NASA Road. The boundary of this project will run from Abigail Lane to the West NASA Road/Grissom Road intersection.

 

On September 29, 2020, the City passed Resolution 2020-124 which authorized the use of eminent domain proceedings for land needed for this Project.  During discussion of the agenda item, Council requested that this matter be brought back for consideration before the eminent domain lawsuit is filed.  This subsequent resolution constitutes that separate action.   

 

Since staff is returning to Council anyway, our new eminent domain attorney (Loren Smith with Olson & Olson) requested that we re-adopt the resolution under a record vote (not on the consent agenda) using specific language for the motion.
