Consider and take action on a variance request from Chapter 42, Section 42-134, of the Code of Ordinances of the City of League City, to allow a well bore to be located within 600 feet from a single-family property (Executive Director of Development Services)
Background:
Approval of this variance request will permit the well bore for the Tidwell #2 site to be located within no closer than 480 feet from the closest residence.
Project Summary:
When the request for a permit for drilling this well was addressed at the Council meeting on April 13, 2021, this particular variance request was eliminated from discussion and no action was taken. The requirement for drilling is to be a minimum of 600 feet away from a residence or have notarized affidavits from the property owner consenting to the lesser distance. In this case, that distance would be 480 feet to the closest residence.
Since the April 13th Council meeting, the applicant has made a good faith effort to obtain consent from the affected residents and ten have agreed to and signed a notarized affidavit. It is unlikely the remaining four will agree to the variance.
Staff believes that the applicant has made a good faith effort to work with the residents, and as such, supports the variance to allow a well to be located 480 feet from the closest residence.
