Consider and take action on a resolution authorizing a construction contract with C4 Partners, LLC for the Bay Ridge Flood Reduction - Phase 2 (DR2005), in an amount not to exceed $8,526,953.80, authorizing $700,000 for a work change directive budget, and authorizing a construction material testing services contract with Terracon Consultants in an amount not to exceed ---$33,788 for a total construction budget of $9,260,741.80 (Executive Director of Capital Projects)
Background:
Approval of this resolution will authorize the award of the construction contract to C4 Partners, LLC for the construction of the Bay Ridge Flood Reduction - Phase 2 (DR2005).
The Bay Ridge Flood Reduction Project - Phase 2 is the third of four planned projects impacting the Gum Bayou Watershed and the Bay Ridge Subdivision. These drainage projects will help with street ponding and reduce the flooding potential during major rainfall events.
On November 5, 2019, Council approved a professional services agreement in the amount of $263,000 with LJA to provide engineering design and construction services for a 42,000 gallon per minute stormwater pump station to be added to the existing detention pond in the Bay Ridge Subdivision. There was also an allowance for additional design services to be performed on an as-needed basis, which included lowering of the existing detention pond based on the outcome of the Gum Bayou H&H study.
This project advertised on March 29, 2022; and four (4) sealed bid were received on May 16, 2022 (Bid No. 22-CIP-004). C4 Construction, LLC is $487,515.17 less than the next lowest bidder. C4’s bid is based on 450 calendar days from notice to proceed to substantial completion, with another 30 days to final completion. Attached is the City’s engineering consultant’s recommendation of award, along with the bid tabulation.
In the FY2022-2026 CIP, Construction for Bay Ridge Flood Reduction - Phase 2, is budgeted at $6 million. The overage of $3.2 million is covered by utilizing a first in first out cash management approach and re-evaluating project schedules for prior debt sold. As projects come in over or under budget, this cash management approach ensures the city is exhausting its oldest debt first, freeing up newer debt issuances to award current contracts.
As it stands today with four of the projects currently in construction, the Prop A (Drainage) GO Bond Program is projected to be within the $73 million authorized authority based on current estimated construction budgets after scope modifications discussed at the March 8, 2021, work session.
This is made possible by leveraging GO Bond funding with grants from HMPG (FEMA) and CDBG-DR to help subsidize the cost of qualified Drainage GO Bond projects. Projects with construction cost estimates over the allotted grant threshold will pause for construction to request additional funding to cover the overages.
This construction bid award represents the ninth GO Bond project to start construction as approved at the May 2019 Election, and the fourth Prop A Drainage project to start construction. The others are Bay Colony Detention, Bay Ridge Flood Reduction - Phase 3, Oaks of Clear Creek Drainage Improvements, Calder Road South Reconstruction, Grissom Road, League City Parkway @ Hobbs, League City Parkway @ Brittany Lakes, and League City Parkway Intersections Improvements.
Pursuant to an inquiry from Mr. Bowman, who resides in Bay Ridge Subdivision, City staff, the consultant, and Mr. Bowman had a conference meeting on Wednesday, June 22, to discuss his issues. In response to the first two concerns (suggesting Gum Bayou have an electronic control level that interfaces with the pond and suggesting sequencing the variable frequency drives better to control the pump operation), City staff agreed to add an HCFCD flood gauge in Gum Bayou estimated at approximately $25,000.
To provide access to a simple internet screen that mirrors critical SCADA data during storms, the City will consider adding a level gauge in the pond and will be open to additional discussion towards a solution. Mr. Bowman also requested the contractor build a temporary haul route into the pond site via Bishop’s Bridge or Village Way instead of through the neighborhood. The City agreed that City staff and the consultant will direct the contractor to use Bishop’s Bridge for the majority of (estimated around 80%) truck traffic but there will be some truck traffic within the subdivision.

FUNDING
{X} Total funding in the amount of $9,260,741.80 is available from 2021 GO Bond PROP A, Fund 5270, with expenses charged to project expense string DR2005-CONSTRUCT- CONSTRUCT- 21PROPA.
