Consider and take action on a resolution requesting that the Texas Legislature consider amending the Texas Professional Services Procurement Act to allow for competitive procurement of the professional services defined in the Act by home-rule municipalities (Council Member Bowen and Council Member Tressler)
Background:
The Texas Professional Services Procurement Act enumerates eleven (11) categories of professional services that governmental entities, including home-rule municipalities, are prohibited from procuring via a competitive process.
All home-rule municipalities must be responsible stewards of tax dollars. It is an accepted fact that competition among providers of professional services by nature yields pricing more advantageous to the seeker of such services.
The concerns regarding qualifications and competency of a potential provider of professional services can be addressed within the parameters of existing procurement mechanisms, including competitive sealed proposals.
The Texas Legislature could strike a balance between reducing cost to the taxpayers of necessary public projects while still ensuring that the professional is qualified and competent by allowing but not requiring competitive procurement of professional services by home-rule municipalities.
