Consider and take action on a resolution authorizing an Agreement to Contribute Right of Way Funds (Fixed Price) with the State of Texas through the Texas Department of Transportation for the Right of Way Project - Farm to Market 646 from Edmund Way to FM 1266 (TxDOT CSJ: 3049-01-032) and payment by the City in an amount not to exceed $490,000 (Executive Director of Capital Projects)

 

Background:

Approval of this item authorizes an Agreement to Contribute Right of Way Funds (Fixed Price) with the State of Texas through the Texas Department of Transportation for the Right of Way Project - Farm to Market 646 from Edmund Way to FM 1266 (TxDOT CSJ: 3049-01-032) and payment by the City in an amount not to exceed $490,000. Since environmental clearance on the original project FM 646 from I-45 to Bayshore Boulevard in May 2011 the section from I-45 to Edmund Way has been constructed as a four-lane divided roadway with a raised median, sidewalks and curb-gutter drainage, which is approximately 1.3 miles of the original project. From west of Edmund Way to Bayshore Blvd, FM 646 is a two-lane undivided rural roadway with no sidewalks, open ditch drainage and an existing at-grade crossing at the railroad tracks. A re-evaluation is being conducted to address proposed design changes to the approved design on FM 646 from Edmund Way to FM 3436. FM 646 serves as a main east-west arterial access route between I-45 to Bayshore Blvd. It provides a primary connection to I-45 and SH 146, both of which are utilized by commuters to access the surrounding communities of Dickinson, League City and Bacliff. This corridor also serves as a hurricane evacuation route.

 

TxDOT began detailed engineering design in 2016 for the second portion of the phased FM 646 project from Edmund Way to FM 3436. At that time, TxDOT determined that additional right of way would be necessary for the addition of stormwater detention ponds and for access roadway improvement at the proposed overpass at the SH3 and railroad crossing. The portion of the project from Edmund Way to FM 1266 is funded and construction is anticipated to begin in early 2023. Right-of-Way acquisition for this segment is underway for parcels covered in the original 2011 environmental document. Parcels for this segment included in this re-evaluation (approximately 12.9 acres) would be acquired after additional environmental approval

 

This project proposes to upgrade FM 646 to a 4-lane divided roadway to accommodate current and future predicted traffic demands. The proposed improvements would increase reliability by bringing the pavement condition as well as the roadway to current design standards. Decreased congestion resulting from the improvements would improve emergency incident response times, as well as improving air quality.

 

Approval of this agreement would result in this project becoming a 90% State (TxDOT) - 10% Local (City) cost share project. As can be seen from the table below, this agreement obligates the City to $490,000 toward the cost of acquiring right of way and relocation or adjusting utilities for the project. The local governments fixed price contribution is not subject to adjustment unless:

1.                     site conditions change;

2.                     work requested by the local government is ineligible for federal participation; or

3.                     the adjustment is mutually agreed on by the State and the Local Government

overruns will be the City’s responsibility.

 

This agreement calls for a 90% State (TxDOT) - 10% Local (City) cost share, with the cost estimates and shares as follows.
