Consider and take action on a resolution authorizing Change Order No. 3 with WadeCon, LLC. for the Right-Turn Lane at League City Pkwy and Hobbs Rd Project (ST2002) in an amount of $28,258.00 for a total increased contract amount of $361,803.12 (Executive Director of Capital Projects)

 

Background:

Approval of this item will authorize Change Order No. 3 with WadeCon, LLC. for the Right-Turn Lane at League City Pkwy and Hobbs Rd Project (ST2002) in an amount of $25,258.00.  This will be the final payment and will close project.

 

On June 23, 2020, City Council awarded the construction contract for the Right-Turn Lane at League City Pkwy and Hobbs Rd Project (ST2002) to WadeCon, LLC. in the amount of $307,619.00.

 

A Change Order No. 1 at a net zero dollar value was issued to change the proposed pavement section.  Due to a restricted workspace and to expedite putting traffic back on Hobbs Road, contractor, City, and Engineer worked together and replaced the proposed 8” concrete pavement on 8” of lime stabilized subgrade with 11” fast track concrete pavement on existing proof rolled subgrade.  

 

Change Order No. 2, in the amount of $25,926.12 was approved administratively on May 11, 2022.  This Change Order consisted of final adjustments to construction bid items, including additional traffic control devices due to school, concrete pavement, pavement marking and some miscellaneous traffic signal cables.  The $25,926.12 was transferred from the City Council-approved work change directive budget to the construction fund balance. 

 

To close out the contract, City has been negotiating with WadeCon on the amount and method of payment for the additional Type B Sidewalk which includes a variable height retaining wall on back side of it.  This Change Order No. 3 consists of an additional 158.79 SY of Concrete Sidewalks (Type B).   The original bid quantity of 35 SY of Type B Sidewalk was to be used at spots where back slopes were too steep.   However, during construction, options were looked at for other less steep slopes.  Options such as additional easement from school, removing and regrading the back slopes further into school property and then block sodding all disturbed areas.  Damage to existing trees caused by bringing the slopes down was also considered which could have required possible removal and relocation of trees.  It was decided that extending the Type B sidewalk with variable height retaining wall from the school driveway on League City Parkway to Hobbs Road would be more feasible and less impact to school property. All trees were protected and not relocated.  

 

 

 

 

 

With the approval of Change Order No. 3, change orders represent 17.6% increase in the contract price as adjusted below:

The original contract time for completion of construction was 120 calendar days.  No additional time was added in Change Orders 1 and 2, and no additional time is added with Change Order No. 3. 

 

This project reached final completion in November 2020 and retainage was released while City staff worked with the contractor to come to an agreement on this final pay item.  Upon approval of Change Order No. 3, the project will be closed out.

FUNDING

{X} Funding in the amount of $28,258 is available from the remaining construction contingency of $4,343.12 and the balance of $23,914.88 will come from the available balance of the 2019 PROP B issuance.  The funds are available from the construction of Grissom Rd award savings.  The full $28,258 expense will be charged to project expense string ST2002-CONSTRUCT-CONSTRUCT-19PROPB.
