Consider and take action on an ordinance amending Section 22-280 entitled, "Cross-Connection Control Program" of Chapter 22 of the Code of Ordinances of the City of League City entitled, "Building and Building Regulations" to remove the requirement that all residential backflow assemblies be tested every three years (Executive Director of Development Services)
Background:
Ordinance 2012-10 adopted an earlier version of the City’s Backflow Prevention assembly testing program. This ordinance noted that “All backflow prevention assemblies shall be tested upon installation by a recognized backflow prevention assembly tester and certified to be operating within specifications. Backflow prevention assemblies which are installed to provide protection against health hazards must also be tested and certified to be operating within specifications at least annually by a recognized backflow prevention assembly tester. A test report must be completed by a recognized backflow prevention assembly tester for each assembly tested. The signed and dated original form must be submitted to the City within five working days of the test” (from Section 22-280(a)(1)).
This section of the ordinance meant that backflow assemblies installed on all HOA systems, all Commercial Systems, and residential systems where the resident was on a septic system or using a chemical injected sprinkler system must have their backflow assemblies tested annually.
The City’s Cross-Connection Program has since by amended by Ordinance 2015-41 and Ordinance 2018-21 without any major changes to the above requirements.
In 2016, the Building Department contracted with BSI so that when new, permitted backflow devices were installed, the installer registered the device with BSI. Once registered, BSI would send annual notifications for devices associated with HOAs, Commercial Developments, and residential properties that were either using a chemical feed for irrigation or were using a septic system.
