Consider and take action on a resolution authorizing an interlocal agreement with the Texas Department of Public Safety regarding the “Failure to Appear” program for the League City Municipal Court of Record (Director of Finance)
Background:
Approval of this item will authorize a new interlocal agreement for implementing provisions of the Texas Transportation Code, Chapter 706 (Denial of Renewal of License for Failure to Appear). Through this program, a person's driver license renewal may be denied if he or she fails to appear in court or fails to pay a court fine.
An agreement was originally approved with the Texas Department of Public Safety in 2019 (Resolution 2019-144) and amended in 2020. Due to changes occurring in the Texas 88th Legislative Session, DPS has requested that League City sign a new contract to continue participation in the program.
The following changes were made:
1. Changes to language and restructuring of the original contract to provide clarity regarding the specific responsibilities held by each party.
2. Inclusion of indigency into the program as mandated by House Bill 291, 88th Legislative Session.
3. Language to account for future changes to the current statute, either federal or state, ensuring that the contract remains in compliance with the latest legal requirements until a revised contract is available.
DPS contracts with a private vendor to establish and maintain an automated system whereby information regarding court violators may be stored and accessed by DPS. The City will then file Failure to Appear ("FTA") reports with this private vendor. Using this automated system, DPS may deny the renewal of a driver license of a person who is the subject of a FTA system entry.
