Consider and take action on a resolution authorizing a Tri Party Agreement among the City of League City, the City of Houston, and Baybrook Municipal Utility District No. 1 regarding the annexation and development of approximately 450 acres known as the Midline Tract (Executive Director of Development Services)
Background:
Approval of this resolution will authorize the City Manager to execute a Tri Party Agreement with the City of Houston and Baybrook Municipal Utility District No. 1 (BMUD 1). The purpose of the Tri Party Agreement is to establish coordinated terms and conditions for the annexation of approximately 450 acres (the “Midline Tract”) into BMUD 1 and to set forth the rights and obligations of Houston, League City, and BMUD 1 related to the financing and provision of utility, roadway, park, and drainage infrastructure to serve this area.
Key provisions of the Tri Party Agreement include:
- Houston and League City each consent to the annexation of the Midline Tract into BMUD 1.
- Establishes maximum allowable tax rates and bond issuance requirements consistent with applicable TCEQ rules.
- Requires de-annexation of the Midline Tract from BMUD 1 upon retirement of bond debt associated with the tract.
- Provides that League City will furnish municipal services (including water, sewer, fire protection, and solid waste collection) to the Midline Tract after annexation into BMUD 1.
This resolution is a companion agenda item to the ordinance authorizing the Utility Agreement with BC-SB Baybrook JV, LLC, on behalf of BMUD 1 which was adopted by Council on September 23, 2025, via Ordinance 2025-36. Together, the Utility Agreement and the Tri Party Agreement form the framework by which League City, Houston, and BMUD 1 will coordinate annexation, development, and utility service responsibilities for the Midline Tract.
Execution of both the Tri Party Agreement and the Utility Agreement is contingent upon the prior execution by the City of Houston.
