Consider and take action on a resolution to support the application to the Texas Commission on Environmental Quality (TCEQ) for a Municipal Setting Designation (MDS) for Lots 3A and 4, Block 17 of the Clearlake Industrial Park, Webster, Harris County, Texas (Deputy City Manager)
Background:
Approval of this resolution will support the application for a Municipal Setting Designation (MSD) from Texas Commission on Environmental Quality (TCEQ). An MSD is an official state designation given to property within a municipality or its extraterritorial jurisdiction. It certifies that designated groundwater at the property is not used as potable water, and is prohibited from future use as potable water because that groundwater is contaminated in excess of the applicable potable-water protective concentration level.
Kellogg, Brown & Root, LLC (Applicant) filed information with the City of League City, Texas, requesting the City support a MSD for the properties located at 900 and 902 Gemini Street, Webster, Harris County, Texas. The applicant is requesting support from League City due to a condition of approval by TCEQ that states the city council of each municipality that owns or operates a groundwater supply well located not more than five (5) miles from the site must show support for the MSD.
While the proposed MSD site is in Webster, League City owns and operates multiple water wells within the five (5) mile notification radius. League City wells do not take water from and are protected against the shallow water sand contamination.
